Title 30 › Chapter 22— MINE SAFETY AND HEALTH › Subchapter I— GENERAL › § 821
If a mine or part of a mine is closed by an order under sections 813, 814, or 817, miners working when the order is issued who are kept from working must be paid their regular wages for the time they are idle, but not for more than the rest of that shift. If the order is still in effect at the next shift, miners on that shift who are kept from working must be paid their regular wages for the time they are idle, but for no more than four hours of that shift. If the closing is under section 814 or 817 because the operator failed to follow safety rules, miners kept from working must be paid after a public hearing is held quickly and the order becomes final, for the time they were idle or for one week, whichever is less. If an operator violates or refuses to follow an order under sections 813, 814, or 817, miners who would have been pulled out or kept from entering must be paid from when the order was issued until the order is obeyed, canceled, or ended. The Commission can order these payments after a miner or their representative files a complaint and after a hearing under section 554 of title 5.
