The Secretaries of Labor and Health and Human Services may make the rules they need to carry out this subchapter. Those rules must follow the procedures in section 553 of title 5, even if subsection (a) of that section would say otherwise. By the end of fiscal year 2003 and each succeeding fiscal year, the Secretary of Labor must send Congress a yearly report about the matters in this part and part B of this subchapter. Each report must meet the submission rules in section 942 of title 33. Operators must still follow State workmen’s compensation laws unless a State law conflicts with this subchapter and the Secretary’s rules say it does not apply. If a State law gives greater benefits than this subchapter, that higher benefit is not treated as a conflict.
