Each agency that runs covered housing must set up a way to check if the rules in this part are being followed. They should use existing review systems when they can and talk with the Gender-based Violence Prevention Office, the Violence Against Women Act Director, and other relevant officials. Reviews must look at six things: bans on denying help or housing because of domestic violence, dating violence, sexual assault, or stalking; confidentiality rules; required notices; what documents are accepted; emergency transfer rules; and protection against retaliation. Agencies must do these reviews on a regular schedule. No later than 2 years after March 15, 2022, each agency must write rules using the rule-making process in section 553 of title 5. The rules must set clear compliance standards, require detailed reports (including how many emergency transfers were requested and granted and how long transfers took), and set standards for corrective action when programs fail to meet the standards. Agencies must consult experts on victims’ housing needs and housing program managers when making the rules. Each agency must also prepare an assessment of the review results that covers each topic above and make that assessment public.
