Title 38 › PART II — GENERAL BENEFITS › CHAPTER 11 — COMPENSATION FOR SERVICE-CONNECTED DISABILITY OR DEATH › SUBCHAPTER II — WARTIME DISABILITY COMPENSATION › § 1116A
Veterans who served offshore of the Republic of Vietnam from January 9, 1962, to May 7, 1975 are treated as if they were exposed to herbicides and as if certain diseases that show up later were caused or made worse by that service, even if there was no medical record of the disease while they were serving. The places counted as "offshore" include areas within 12 nautical miles seaward of a line that begins at the southwestern border of Vietnam and Cambodia and runs through specific coastal and island points listed in the law. Payment start dates for benefits follow the usual rules under section 5110. But if a veteran or survivor filed a claim for one of these diseases on or after September 25, 1985 and before January 1, 2020 and it was denied because it did not show the disease came from service, and then they filed again on or after January 1, 2020 and the new claim is approved under this rule, the award’s start date is treated as the date of that earlier claim. Herbicide agent — see section 1116(a)(3) for the law’s definition.
