Title 38 › Part II— GENERAL BENEFITS › Chapter 15— PENSION FOR NON-SERVICE-CONNECTED DISABILITY OR DEATH OR FOR SERVICE › Subchapter II— VETERANS’ PENSIONS › § 1511
The Secretary must pay each eligible veteran of the Indian Wars a monthly pension. The basic payment is $101.59. If the veteran needs regular aid and attendance, the payment is $135.45. A veteran is eligible if they served at least 30 days in an Indian War or served for the whole war. A veteran may choose to get the pension and rules that apply to World War I veterans under section 1521. That choice is final except as explained next. For veterans needing regular aid and attendance, the Secretary must pay each month whichever is higher: $135.45 or the amount under section 1521. Any change in amount starts the first day of the month when the facts change and is made automatically.
