Title 38 › Part II— GENERAL BENEFITS › Chapter 18— BENEFITS FOR CHILDREN OF VIETNAM VETERANS AND CERTAIN OTHER VETERANS › Subchapter IV— GENERAL PROVISIONS › § 1831
Defines who counts as a child and who is covered for health care and benefits under this chapter. A "child" means a biological child, of any age or marital status, who was conceived after the veteran first entered service in the country tied to the benefit rule. For the Vietnam-related rules, the child must have been conceived after the veteran first entered the Republic of Vietnam during the Vietnam era. For the Korea- and Thailand-related rules, the child must have been conceived after the veteran first entered the covered service in Korea or Thailand, as those parts of the law define. A "covered child" is a child who can get health care and benefits under this chapter. A "covered veteran" is someone whose children can get those benefits. A "Vietnam veteran" is anyone who served in Vietnam during the Vietnam era, no matter how their service was labeled. The Vietnam era dates are January 9, 1962 through May 7, 1975 for one part of the chapter, and February 28, 1961 through May 7, 1975 for the other part.
