Pays a death benefit when a service-connected death happens to a person who was eligible for basic educational help under this chapter, or who would have been eligible except for being on active duty, and who dies while on active duty or within one year after leaving active duty. The money goes to the first living person in this order: the beneficiary named under the person’s Servicemembers’ Group Life Insurance, the surviving spouse, the surviving children (split equally), or the surviving parents (split equally). If none of those people survive, no payment is made. The payment amount equals the total of money taken from the person’s basic or retired pay for the education program, any amounts the Secretary collected from the person, and the person’s contributions to the program, minus any education benefits already paid to the person and minus any accrued benefits paid or payable. The payment is treated as a benefit and as an earned entitlement under this subchapter for purposes of section 3035(b)(1).
