Veterans who were in the Post‑Vietnam Era Veterans’ Education Account (VEAP) on October 9, 1996, and who were on active duty that day, may choose, within one year starting October 9, 1996, to switch from VEAP to the basic Montgomery GI Bill. To do this they must have a high school diploma (or equivalent) or at least 12 semester hours of college credit before applying, and if they leave active duty after choosing, they must have an honorable discharge. If they choose the switch, they stop being in VEAP, unused contributions made by the veteran are refunded to the veteran, certain unused government contributions go back to the Department of Defense, and some Defense contributions may remain to pay other specific benefits. The veteran’s basic pay will be reduced until the total taken equals $1,200. If the full $1,200 is not taken from pay before discharge, the Secretary will collect the rest from the veteran and turn it over to the U.S. Treasury. The military must give written notice of important rules and get a signed acknowledgement. A second chance was made for a limited group who were VEAP participants on or before October 9, 1996 and who stayed on continuous active duty through at least April 1, 2000. Those people could, during the one‑year period after the date this part was enacted, make the same switch. For them, pay reductions total $2,700. If the $2,700 is not all taken from basic pay before discharge, the veteran can either pay the balance within 18 months or have it taken from retired or retainer pay. No Montgomery GI Bill payments are made until the money is collected or the retired/retainer pay is reduced. The military must notify VEAP participants about these opportunities.
