If a person dies while a benefit claim or an appeal the Secretary handles is still pending, someone who would be eligible to get the benefits owed to the deceased can ask to replace them as the claimant. The request must be filed within one year after the claimant's death. The person asking must give proof that they have the right to be substituted within any time limits the Secretary sets. Who can substitute is decided under section 5121, and the substitution follows the Secretary’s rules.
