You cannot be made to owe money to the United States for a benefit run by the Under Secretary for Benefits if the debt happened because a Department employee or official failed to process your information on time. This rule does not change the criminal or forfeiture rules that apply to fiduciaries under chapter 61. If the Secretary finds an overpayment, the Secretary must notify you and explain how to dispute it or ask for a waiver. The Secretary may not start collection actions under 31 U.S.C. 3711 until 90 days after that notice, unless waiting would likely make repayment harder, cause referral to the Treasury Offset Program, or would not be in your best interest.
