The Secretary must not cut the number of employees at a specific pay grade unless first sending a detailed plan and explanation to the House and Senate Veterans’ Affairs Committees. The plan must include a finding, with supporting data, that the Department has too many workers at the chosen grade compared with similar jobs and pay in other federal agencies and non-federal employers. Any cut cannot start until 90 calendar days after the committees get the report (not counting days when either House of Congress is not in session). The rule covers three groups of employees: health-care workers who give direct patient care or related services; professional employees as defined in 5 U.S.C. 7103(a)(15); and computer specialists. If either committee asks, the Comptroller General must send a report no later than the 45th day after the Secretary’s report that says whether the Secretary’s finding and data are accurate. For employees not in the three groups above, the Secretary may not reduce their numbers at a faster rate in any fiscal year than the combined rate of reductions in the same grade across all other federal agencies.
