The Under Secretary for Health may hire people who are not U.S. citizens under sections 7405 and 7406 when they cannot find qualified U.S. citizens. In that situation, the Under Secretary can ignore the citizenship rule in section 7402(c) and other laws that would normally stop hiring or paying non‑citizens. The Under Secretary can also waive some rules in section 7402(b) about professional licenses, state licensure, and a psychologist internship for those hires. Waivers for licenses or internships are allowed only if the person will do research or teach and will not give direct patient care. A waiver of state licensure is allowed if the person will work outside the United States and is licensed where they will serve. Training for full‑time physician assistants or expanded‑function dental auxiliaries counts as full‑time under chapter 34 unless classroom plus on‑the‑job training totals less than 30 hours per week. People hired into the job groups in 7401(1) or 7406 must meet section 7402(d) and its rules. Part‑time hires under 7405 and 7406 are not covered by the part‑time career rules in chapter 34 of title 5, under section 7425(b).
