Require terms in every grant or contract to make sure the project meets its goals. The Secretary must check how grants and contracts are doing on a regular basis. No organization can get money unless it agrees to set up proper money controls and accounting, keep clients’ health records private, and — when serving Native Hawaiians who largely do not speak English — have a workable plan to provide services in the right language and culture and name at least one person who is fluent in both English and that language. If services are paid for under Hawaii’s Medicaid plan, the provider or any contractor it hires must be enrolled and able to receive Medicaid payments. Recipients must send an annual report to the Secretary and to Papa Ola Lokahi about service use, total costs, and the average cost per user. Except for certain grants covered elsewhere in this chapter, recipients may not spend more than 10% of these funds on administration. Before renewing a poorly performing contract, the Secretary must try to fix problems and change the contract. If problems can’t be fixed, the Secretary can stop renewing it and hire another group serving the same Native Hawaiian population. Contracts must follow federal contracting laws, though the Secretary may sometimes negotiate them without public advertising and exempt them from two procurement rules. Payments can be made in advance, by reimbursement, or in installments. Recipients must file quarterly reports each fiscal year on activities, how federal money was spent, and other requested information. Records and reports can be audited by the Secretary, the HHS Inspector General, and the Comptroller General. The cost of one annual private audit by a certified public accountant is an allowable expense.
