Requires public agencies that run regular fixed-route transit (not systems that only do commuter bus service) to give paratransit and other special rides to people with disabilities. The rides must be enough to give people with disabilities service that is similar to what riders without disabilities get, and response times must be comparable when possible. The rides must be offered to three kinds of people with disabilities: those who cannot get on, ride, or get off accessible vehicles without help; those who need a wheelchair lift or boarding device when an accessible vehicle is not available at the time they want to travel; and those who have an impairment-related condition that keeps them from getting to or from a boarding spot. One companion must be allowed, and more companions can ride if there is room and doing so does not deny service to others. The Secretary must issue final rules not later than 1 year after July 26, 1990. The rules must set minimum service standards, cover the agency’s whole service area except parts that only have commuter bus service, allow agencies to claim an undue financial burden (so they only must provide services they can afford), and let the Secretary require more service in some situations. Agencies must hold a public hearing, get public comment, consult people with disabilities, and submit and begin a plan for providing services within 18 months after July 26, 1990 and then every year after that. The Secretary will review plans and can disapprove them. If a plan is disapproved, the agency must fix and resubmit it and start it within 90 days. The law says “discrimination” includes failing to submit or start a plan, failing to fix a disapproved plan, submitting a plan that still fails, or not providing services promised in the plan. Agencies may also provide more or extra services than the rules require.
