National service programs that get help under section 12571 must pay each full-time participant a living allowance at least equal to the average annual subsistence allowance paid to VISTA volunteers under section 4955. The total yearly allowance cannot be more than 200 percent of that VISTA average, unless subsection (c) applies. If a participant’s service includes hours covered by a Federal work-study award under part C of title IV of the Higher Education Act of 1965 (42 U.S.C. 2751 et seq.), the allowance must be reduced by the work‑study amount. Allowances are prorated for terms under 12 months. The Corporation can waive the minimum if the program shows the rule conflicts with its goals and the amount offered still covers needed living costs (like food, housing, and transportation). The minimum rule does not apply to programs that existed on September 21, 1993. A professional corps program described in section 12572(c)(1)(D) may give more than the 200 percent cap, but any extra money cannot come from section 12571 funds, and the program must be run directly by the applicant and meet urgent unmet needs as the Corporation decides. Funds from section 12571 may pay employer payroll taxes and workmen’s compensation taxes when those taxes apply. States or other recipients must provide or arrange a basic health plan for full‑time participants who lack other coverage; the Corporation will set minimum standards, allow certain substitutions, and prevent participants from dropping existing plans. Recipients may offer a different plan if its fair market value is equal to or greater than the Corporation’s minimum plan and it follows other laws. Recipients must also make child care available or give a child care allowance to full‑time participants who need it, under Corporation guidelines on when and how much. Recipients must provide reasonable accommodations, including auxiliary aids and services, for qualified participants with disabilities.
