The Secretary can do many things to run the loan and housing programs under this subchapter. He or she can make small contracts for services and supplies under $300 without using the usual federal buying rule in section 6101 of Title 41. The Secretary can enter into subordination or subrogation agreements. The Secretary can settle, reduce, or write off claims and change or release loan security, leases, or contracts. That includes releasing people from personal debt, with or without payment. The Secretary can collect debts and take cases to court. Most lawsuits are handled under the Attorney General’s supervision by the U.S. Attorneys, but for cases under section 1472 the Secretary may use the Department of Agriculture’s General Counsel or hire private lawyers if the Secretary finds they are competent, cost-effective, and will speed or protect housing. The Secretary must send Congress a yearly report about any private-lawyer contracts, showing costs and savings from faster foreclosures. The Secretary can buy or take title to foreclosed property, operate, repair, lease, and sell it. Before selling for residential use, the property must meet decent, safe, and sanitary standards and the energy rules in section 1479(a), or the buyer must agree to meet them. The Secretary can transfer inventory homes for rental or cooperative use under section 1485 with mortgages up to 50 years, or for rental under section 1484 with mortgages up to 33 years, to qualified organizations, sometimes at less than appraised value to help very low-income families, consistent with section 1490a(d)(1). Applications received before an area stopped being “rural” (as defined in section 1490) can still be processed and helped as if the area were rural. The Secretary may issue appeal rules and notices for denied or reduced help, use powers in sections 1150–1150b of Title 12 for debts, hire fee inspectors and appraisers and include their cost in loans or grants, and make other rules needed to carry out the program.
