Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XVII — BLOCK GRANTS › Part A — Preventive Health and Health Services Block Grants › § 300w–1
The Secretary must split the money available under section 300w among the States. Part of each State’s share is set so that it keeps the same ratio as the money that State and its local entities got in 1981 from a group of public‑health grant programs (these include programs like rodent control, community and school fluoridation, hypertension work, and several other listed sections). Some of the funds are instead allotted to States based on their population under section 300w(b). If a State does not apply, gives up some of its money, or has part of its allotment offset or repaid, the leftover funds are reallocated to the other States in proportion to their allotments. If an Indian tribe or tribal organization asks and the Secretary agrees the tribe would be better served, the Secretary must reserve from that State’s allotment an amount based on the tribe’s 1981 share and grant it to the tribe if the tribe files an approved plan. The meanings of “Indian tribe” and “tribal organization” are the same as in 25 U.S.C. 5304(b) and (c). The Secretary must also study and develop a fair formula for dividing funds, consider State finances, populations, and other factors, and report recommendations to Congress by June 30, 1982.
