Grants for a project won't be approved unless the Secretary finds that all laborers and mechanics hired by contractors or subcontractors on any construction paid with those grants will be paid at least the local prevailing wage rates. Those prevailing rates are set by the Secretary of Labor under sections 3141–3144, 3146, and 3147 of title 40. Small amounts used only for preliminary or full energy audits or technical assistance, or a project whose total cost is $5,000 or less (not counting audit or technical assistance costs), are excepted. The Secretary of Labor has the enforcement authority and duties described in Reorganization Plan Numbered 14 of 1950 (15 F.R. 3176; 5 U.S.C. Appendix) and section 3145 of title 40.
