Title 42 › CHAPTER 99 — OCEAN THERMAL ENERGY CONVERSION › SUBCHAPTER I — REGULATION OF OCEAN THERMAL ENERGY CONVERSION FACILITIES AND PLANTSHIPS › § 9111
You must have a federal license to own, build, or run an ocean thermal energy conversion (OTEC) facility or an OTEC plantship that is U.S.-documented, sits between the high-water mark and the outer edge of the U.S. territorial sea, or is tied to the United States by a pipeline or cable. U.S. citizens also need a license to own or run a plantship, unless the Administrator finds a foreign nation’s license to be compatible after talking with the Secretary of State. The Administrator will take applications and may issue, change, transfer, or renew licenses under the rules in this law. The Administrator can deny a license for many reasons, including inability to follow laws or license rules; harm to national security or national policy goals; interference with navigation or other sea uses; an EPA finding within 45 days after public hearings that the project breaks environmental laws; an antitrust problem or an unfinished 90-day antitrust review; objections from certain federal departments or an adjoining coastal State; plans to document the project under a foreign flag; failure to agree to use U.S.-documented ships to bring products to the U.S.; design that would block existing cables or pipelines; or harmful thermal effects on other OTEC projects or on other nations’ waters without State Department approval. Licenses come with conditions, must be agreed to in writing, and require bonds or other guarantees to clean up or remove facilities when a license ends, with limited waivers for seabed parts. Licenses may be transferred if in the public interest and the new owner qualifies. Any qualifying U.S. citizen can get a license. A license can last up to 25 years, and the holder has a first chance to renew for up to 10 more years at a time, subject to the same rules.
