Title 42 › CHAPTER 106 — COMMUNITY SERVICES BLOCK GRANT PROGRAM › § 9915
When a State finds that an eligible entity is not following its agreement or meeting State standards, the State must tell the entity what is wrong and require fixes. The State must offer training and help if it is appropriate and send a report to the Secretary about that help, or explain why help is not appropriate. The entity may be allowed to write and start a quality improvement plan within 60 days of being told. The State must either approve that plan or explain why not within 30 days after getting it. After giving notice and a chance for a hearing, the State can begin steps to end the entity’s designation or cut its funding if the problem is not fixed. If the State tries to end designation or cut funding, the Secretary will review that decision if asked. The Secretary must finish the review within 90 days after getting all needed documents, or the State’s decision becomes final at the end of the 90th day. If the State cut funding before finishing its hearing and before the Secretary’s review and the State broke the assurance in section 9908(b)(8), the Secretary can give money directly to the affected entity until the issue is fixed. The State’s next grant or allotment under sections 9905 or 9906 will be reduced by the amount the Secretary provided.
