Title 43 › CHAPTER 42 — RURAL WATER SUPPLY › SUBCHAPTER I — RECLAMATION RURAL WATER SUPPLY › § 2404
The Secretary may, if money is available, take part in appraisal studies for eligible rural water supply projects when a non‑Federal group asks. The Secretary can review a study the group submits, do the study, or give a grant or cooperative agreement to the group to do it if the group is qualified and it is cost‑effective. Any appraisal must be finished within 2 years after it starts. The Secretary had to create criteria for these appraisals not later than 1 year after December 22, 2006, and those rules must include ways to scale the work to the size and cost of the project. After an appraisal is submitted or finished, the Secretary will write a report. The report checks whether the project meets the appraisal and eligibility rules; if water supplies and rights exist (including lower quality, nonpotable, or reuse sources); effects on public health and safety; current and future water demand; environmental and regional benefits; integrated water management and flexibility (like local control and water banking/markets); long‑term protection of water supplies; and gives preliminary cost estimates and whether the non‑Federal group can pay 100% of operations, maintenance, and replacement. The report will say if a full feasibility study should start. The Secretary must tell a submitting group within 90 days if the appraisal lacks needed information. Federal funds will cover up to $200,000 of an appraisal. Costs above $200,000 are split 50/50 unless the Secretary lowers the non‑Federal share for a strong federal interest, and the non‑Federal share can be in‑kind. The Secretary must consult with the project group, state, tribal, local, regional, and other federal agencies and identify possible funding sources, make the report available on request, and publish its availability.
