Title 45 › Chapter 16— REGIONAL RAIL REORGANIZATION › Subchapter VII— PROTECTION OF EMPLOYEES › § 797b
Workers who lose their jobs must get the first chance to be hired by another railroad for a job they are qualified for in the same job type if they worked in that job for at least one year. This does not apply when the opening is filled under a required or allowed affirmative‑action plan. A railroad recalling its own furloughed workers is not treated as hiring new employees. The first‑hire right is equal in priority to the first‑hire rights in sections 907 and 1004.
