If an employee takes benefits from an agreement under section 797 or a termination allowance under section 797a, they must give up any other employee-protection benefits from any law or contract that was in effect on August 13, 1981. They also give up any legal claim that they lost benefits because of the Northeast Rail Service Act of 1981. They do not give up benefits under sections 797b and 797c, and they keep their rights under the Railroad Retirement Act of 1974 (45 U.S.C. 231 et seq.) and the Railroad Unemployment Insurance Act (45 U.S.C. 351 et seq.). Any benefits received under an agreement under section 797 or a termination allowance under section 797a count only as compensation for the Railroad Retirement Act of 1974 (45 U.S.C. 231 et seq.) and for figuring base-year compensation under the Railroad Unemployment Insurance Act (45 U.S.C. 351 et seq.).
