Title 46 › Subtitle Subtitle II— Vessels and Seamen › Part G— Merchant Seamen Protection and Relief › Chapter 103— FOREIGN AND INTERCOASTAL VOYAGES › § 10304
Requires a standard written agreement between the ship’s captain (master) and the crew. It must name the ship, the master, and the voyage or its general route and length. Crew must promise to act orderly, honest, sober, hardworking, and to follow lawful orders from the master or other officers about the ship, its stores, and its cargo whether on board, in boats, or ashore. The master must promise to pay the wages shown next to each crew member’s name and to provide food under the attached scale. Other lawful terms can be added. If a crew member steals or willfully or carelessly damages cargo or stores, the cost must be taken from that person’s wages. If someone claims to be able to do a job but proves incompetent, their pay may be reduced to match their ability. A crew member with a complaint must first tell the master or officer quietly, who must deal with it. The agreement must be signed and dated by the master and each seaman, and must record basic details (service time, birthplace, age, height, wages, allotments, etc.). People signed on after the ship leaves must be entered with a consul, customs officer, or other witness.
