Title 46 › Subtitle IV — Regulation of Ocean Shipping › Part A — Ocean Shipping › CHAPTER 401 — GENERAL › § 40102
Defines the key words used in these shipping rules so people know what terms mean. It gives short meanings for things like agreements, carriers, shippers, contracts, and types of cargo and services. Agreement means any written or spoken deal or change to a deal, but not a maritime labor agreement. Antitrust laws means the main federal competition laws, like the Sherman Act, the Clayton Act, the Federal Trade Commission Act, and related acts. Assessment agreement means a way to fund agreed fringe-benefit costs that is not based on a uniform worker-hour rate. Bulk cargo means goods carried in bulk without marks or counts. Certain covered services means things like berthing or bunkering a vessel, loading or unloading at a wharf or terminal, moving buoys for the vessel, and, for injunctions, towing services. Chemical parcel-tanker means a ship with permanent separate tanks and piping to carry several bulk chemicals safely and with the required IMO certificate. Common carrier means someone who offers paid water transport between the U.S. and a foreign country, takes responsibility from port to port, and uses vessels on the high seas or Great Lakes; it excludes certain ferries, tramps, chemical parcel-tankers, and some carriers of perishable farm goods under specific ownership rules. Conference means an approved group of ocean carriers that act together and share a tariff, but not joint services or consortia. Controlled carrier means an ocean carrier owned or controlled by a government, including if the government controls a majority interest or key appointments. Deferred rebate means giving freight money back later as a reward for shipping commitments, paid only if the shipper agrees to further shipments. Forest products includes many bundled or rolled wood and paper items. Inland division is what a common carrier pays an inland carrier for the inland part of through transportation; inland portion is the public charge for that non-ocean part. Loyalty contract means a deal where a shipper gets lower rates by committing cargo and there is a deferred rebate. Marine terminal operator means someone running wharves, docks, warehouses, or terminals tied to common carriers. Maritime labor agreement means a collective bargaining deal in the maritime or stevedoring industry or related preparatory or implementing agreements, but not assessment agreements. Non-vessel-operating common carrier is a carrier that does not operate ships and acts as a shipper to vessel-operating carriers. Ocean common carrier means a carrier that operates vessels. Ocean freight forwarder books space on common carriers for shippers in the U.S. and handles shipping paperwork. Ocean transportation intermediary means either an ocean freight forwarder or a non-vessel-operating common carrier. Service contract means a written deal (not a bill of lading) where shippers promise a volume of cargo over time and carriers promise rates and specific service features. Shipment means all cargo under one bill of lading. Shipper means a cargo owner, the person for whose account transport is provided, the person to receive delivery, a shippers’ association, or a non-vessel-operating common carrier that agrees to pay charges. Shippers’ association means a nonprofit group that consolidates or distributes freight for volume rates. Through rate means the single charge for through transportation. Through transportation means continuous transport between origin and destination offered or performed by one or more carriers (including at least one common carrier) between a U.S. port or point and a foreign port or point.
