Summary

A shipping exchange that arranges ocean transport in U.S. foreign trade must be registered as a national shipping exchange with the Federal Maritime Commission. To register, the exchange must file an application the Commission requires, including the exchange’s rules and other information the Commission asks for. The Commission can exempt an exchange, with or without conditions, if it finds the exchange is already under similar, full regulation in the foreign country where it is based. The Commission must issue rules to set standards for registered exchanges not later than 3 years after the date of enactment of the Ocean Shipping Reform Act of 2022. When reviewing a service contract from a shipping exchange, the Commission may only consider the minimum essential terms for service contracts in section 40502. A “shipping exchange” means a platform that links shippers with common carriers so they can make contracts to move cargo by ship or other transport.
