The Secretary may stop a vessel from leaving the United States if the Secretary thinks the ship is about to leave in violation of the rules. The Secretary does this by telling the owner, operator, agent, master, or person in charge. A ship cannot get official clearance to leave under section 60105 until the problem is fixed. If the ship already had clearance, that clearance will be taken back. The owner, operator, agent, master, or person in charge can ask the Secretary to review the hold under rules the Secretary sets. After the review the Secretary can keep, cancel, or change the hold. The Secretary can require an independent inspection before deciding. If the ship is found to be in violation, the owner must pay the costs of the review and any required inspection.
