Title 46 › Subtitle V — Merchant Marine › Part C — Financial Assistance Programs › CHAPTER 541 — MISCELLANEOUS › § 54101
The Maritime Administration gives money and support to small shipyards. It can make grants, loans, and loan guarantees for capital improvements and pay for maritime training to build worker skills. Money can be used for yard upgrades and worker training, but not to build new buildings or buy land. Up to 2 percent of program funds may pay grant administration costs. The agency must post a Notice of Funding Opportunity no more than 15 days after the appropriations law is signed and must award grants within 120 days. Money a grantee does not spend can be reused for other grants. Federal funds cannot cover more than 75 percent of a project. No more than 25 percent of the program’s yearly funds may go to any one small shipyard location that has more than 600 employees. A training center that got funds under section 51706 cannot get training grants here in the same fiscal year. Applicants must apply within 60 days after the appropriations law is signed and explain the need, how they will do the project, and any other programs that will help. The agency must set accounting and review rules with the Inspector General, require records, and allow audits. The agency will only award grants if matching funds are available, the project can finish without unreasonable delay, and the recipient has the authority to do the work. All products and materials bought with these funds must be made in the United States or mostly made from U.S. materials. The agency can waive that rule if it hurts the public interest, the item is not available in the U.S. in sufficient quality or time, or using a U.S. product would raise cost by more than 25 percent; any waiver must be published in the Federal Register. Definitions (one line each): "commercially available off‑the‑shelf item" — a common commercial item sold widely (not bulk cargo); "product or material" — an item brought to the site for the project; "United States" — includes DC, Puerto Rico, Northern Mariana Islands, Guam, American Samoa, and the Virgin Islands. A "small shipyard" means a single-location shipyard with not more than 1,200 employees.
