The Secretary may act to stop or respond to terrorism, cyber attacks, transnational organized crime, and threats from foreign states. These powers cover people, vessels, and public or commercial structures that are under U.S. jurisdiction and are in or next to the marine environment, and they also cover U.S. vessels and people on those vessels. To do this, the Secretary may order inspections, run port and harbor patrols, set up safety and security zones, make contingency plans, recruit and train Regular Coast Guard and Coast Guard Reserve members, and send properly trained (and armed when needed) Coast Guard personnel to vessels and structures to deter or respond to those threats or to transportation security incidents (see section 70101 of title 46). These actions count as part of chapter 700 for sections 70031, 70032, 70033, 70035, and 70036, and the Secretary may carry them out without following chapters 5 and 6 of title 5 or Executive Orders Nos. 12866 and 13563.
