Title 49 › SUBTITLE VIII — PIPELINES › CHAPTER 601 — SAFETY › § 60105
The Secretary of Transportation cannot set or enforce safety rules for pipelines inside a state when the state’s pipeline safety agency sends a yearly certification saying it regulates and enforces those pipelines, except as provided here and in sections 60114 and 60121. The certification must say the state has legal authority over the pipelines; has adopted each required federal safety rule (or is taking steps to adopt any rule issued within 120 days before certification); uses state employees with required qualifications to do inspections; encourages a damage-prevention program with penalties for violators; can require records, reports, inspections, and approval of inspection and maintenance plans; can use state laws to get injunctions and civil penalties like the federal law; can review required plans and manuals; and has enough trained staff based on pipeline miles, number of services, system age, and environmental or geological risks. Each certification must include a report listing the pipeline operators it covers, accidents in the prior 12 months that caused death, hospitalization, or property damage above an amount the Secretary sets (plus other accidents the state finds significant) and the state’s investigation summaries, the state’s recordkeeping and inspection practices including how many inspections it did in the past 12 months, and any other information the Secretary asks for. The first certification only needs information the state already has. A certification does not cover safety rules issued after the certification date until the state adopts them and re-certifies. The Secretary may monitor the state program and the state must cooperate. If the Secretary finds the state is not enforcing rules well, the Secretary can reject the certification, take federal control, or take other action, but must give notice and a chance for a hearing, and the state must prove it is enforcing the rules.
