The Merit Systems Protection Board can issue subpoenas to make people come to hearings, give testimony, and turn over documents about matters it is handling. Any Board member can sign a subpoena, and Board members or authorized examiners can give oaths and question witnesses. If someone ignores a subpoena, the Board can go to a United States District Court to order the person to appear or produce records, and the court can punish failure as contempt. The Board can also order written depositions at any stage. A deposition is taken by a person the Board picks who can give oaths, and the witness must sign the written testimony. Anyone can be required to appear, testify, and provide documents. A person cannot refuse for the reason that the testimony might make them look guilty or lead to a penalty or loss, and lying while testifying can be prosecuted as perjury.
