OPM or the agency that tests job candidates must drop age, height, and weight rules for a preference eligible unless those rules are needed to do the job. They must also set aside other physical requirements if, after reviewing a doctor's recommendation, they believe the preference eligible can perform the job well. If an examining agency thinks a preference eligible described in section 2108(3)(C) who has a compensable service-connected disability of 30 percent or more cannot meet the job’s physical needs, the agency must tell OPM and the person and explain why. The person has 15 days to reply to OPM. OPM will check that the notice was sent to the last known address, make the final decision before anyone else is hired, consider any reply, send its decision to the agency and the person, and the hiring agency must follow that decision. OPM may not delegate these duties.
