Arbitration can be used to resolve a dispute only if everyone agrees. People can agree before or after a problem starts. They can pick just some issues to arbitrate or require the arbitrator’s award to fall within a set range. The agreement must be written, must list a maximum award, and can set other limits. An agency cannot force anyone to agree to arbitration to get a contract or benefit. An agency worker must not offer arbitration unless they could settle the matter themselves or the agency specifically lets them. Before an agency uses binding arbitration, the agency head must write guidance after talking with the Attorney General and considering the factors in section 572(b).
