Within 180 days, each executive agency head must make a telework policy. The policy must say who can telework, let eligible workers know, and keep work and agency operations from getting worse. Workers cannot telework if they were disciplined for being absent without permission more than 5 days in a year or for using a government computer or doing official duties to view, download, or share pornography (including child pornography). The policy must require a written agreement between the manager and the employee that explains the telework arrangement, and the agreement is needed to telework. Employees can be denied or removed from telework if they do not meet the agreement. People whose daily jobs need handling secure materials or must be done on-site cannot telework, except in emergencies. The policy must be part of the agency’s emergency operations plan and must include rules for temporary approved overseas telework, with limits when secure materials are handled at least monthly. If an employee is put on investigative leave, the agency may require similar work by telework so long as it does not create safety risks, destroy evidence, damage government property, or harm government interests, the employee is eligible, and the agency agrees it is appropriate.
