If no union has exclusive agency-wide recognition, a union that represents a substantial number of an agency’s employees, as decided by the Authority, must be given national consultation rights. Those rights end if the union no longer meets the Authority’s criteria. The Authority decides any disputes about who is eligible or whether the rights continue. A union with these rights must be told about major proposed changes to working conditions and given enough time to share its views and suggestions. The agency must consider those views before making a final decision and must give the union a written explanation for its final action. These rules do not take away the agency’s or a union’s right to bargain.
