Employees may not take part in political activity (1) while on duty; (2) in any room or building used for federal work; (3) while wearing a uniform or official badge that shows their job; or (4) while using a vehicle owned or leased by the U.S. Government. An employee described in paragraph (b)(2) may do political activity otherwise barred in (a) if the costs are not paid with money from the U.S. Treasury. Paragraph (b)(2) covers employees whose duties continue outside normal duty hours and who are either paid from an appropriation for the Executive Office of the President or are appointed by the President with Senate consent, work in the United States, and make U.S. foreign or nationwide federal policy.
