The Secretary of Labor must decide the facts and approve or deny payment after looking at the beneficiary’s claim, the immediate supervisor’s report, and any investigation the Secretary thinks is needed. If a claimant is not happy with that decision, they can ask for a hearing within 30 days. A representative of the Secretary will hold the hearing and the claimant can present more evidence. Within 30 days after the hearing ends, the Secretary must notify the claimant in writing of the new decision, any change to the award, and the reasons. The hearing can be informal, and the representative may accept any relevant evidence.
