Defines three key words used in this part. An "employee" means four kinds of people: a federal employee as defined in section 2105, a Member of Congress or a Delegate, a current or former member of a uniformed service, and someone employed by the District of Columbia government. An "annuity" means a retirement-type payment (including disability and survivor or dependent payments under subchapter II of chapter 7 of title 42 and monthly annuities under 45 U.S.C. 228b or 228e) paid by the U.S. government or D.C. based on civilian service and other creditable service. It does not include VA benefits, pay protected by Article III, portions payable without counting employee service, certain annuities paid before September 26, 1961 or portions that ignore military service credit after September 25, 1961, or retirement benefits awarded before September 1, 1954 or before September 26, 1961 insofar as the person, before those dates, was convicted of offenses named in section 8312 (subsections (b) or (c) as applicable) or violated sections 8314 or 8315. "Retired pay" means retirement, retainer, or equivalent pay for members or former members of the uniformed services and annuities to eligible beneficiaries under chapter 73 of title 10 or section 5 of the Uniformed Services Contingency Option Act of 1953 (67 Stat. 504). It excludes VA benefits and retired pay awarded before September 1, 1954 or before September 26, 1961 to the extent the person, before those dates, was convicted of the offenses named in section 8312 (subsections (b) or (c) as applicable) or violated sections 8314 or 8315.
