The President can restore a person’s right to get retirement pay or a pension if that person was convicted, before, on, or after September 1, 1954, of an offense listed in section 8312 or of an offense that violates section 8314 or 8315. If the President pardons or restores pay, any payments cannot cover time before the pardon date or before the restoration date the President sets. Time served that was refunded under section 8316 only counts after the refunded money is paid back. If pay is forfeited under section 8312 or 8313 after the date this rule was enacted, the spouse can get a spousal pension if the Attorney General finds the spouse fully cooperated with federal investigators and prosecutors.
