An individual, or their survivor or beneficiary, cannot get annuity or retired pay for service that counts toward those benefits, unless section 8311(2) or (3) allows it. The rule applies when the person is charged under military law for offenses listed in 8312(b) (if charged after July 31, 1956) or 8312(c) (if charged after September 26, 1961) and then knowingly stays outside the United States and its territories (including Puerto Rico) for more than one year. Payments stop after that year and continue until all charges are dropped, the person returns and the charges are dismissed, or the person is found not guilty at trial or court-martial.
