Title 5 › Part III— EMPLOYEES › Subpart G— Insurance and Annuities › Chapter 84— FEDERAL EMPLOYEES’ RETIREMENT SYSTEM › Subchapter II— BASIC ANNUITY › § 8413
If an employee or Member leaves federal service after at least 5 years of service, they can get a retirement annuity that starts at age 62. If they leave after at least 10 years but before the minimum retirement age under section 8412(h), they can pick a later start date by filing a written election. The chosen date cannot be before that minimum retirement age and must be before age 62. The election must follow the Office’s rules and is not valid if the person would become eligible for any annuity within 31 days after filing. Choosing this annuity cancels any other annuity rights based on the same service.
