You cannot get a federal annuity under subchapter II or V at the same time as workers’ compensation under chapter 81 subchapter I for the same injury or disability, except for payments under section 8107. You also cannot get an annuity under subchapter IV together with a chapter 81 death benefit for the same person. You may, however, take whichever benefit is larger. If you have an annuity under II, IV, or V and also get a lump-sum payment under section 8135 for that same injury or death, any part of that lump sum that pays for time after the annuity began must be returned to the Department of Labor for credit to the Employees’ Compensation Fund. Before the annuity starts, you must either repay that amount or allow it to be deducted from the annuity.
