Military reserve technicians must be retired and can get an annuity if they lose their job because a disability keeps them from being a member of the reserve or from holding the military grade needed for the job, as long as they are not treated as disabled under section 8451(a)(1)(B), have not been appointed to a Government job, and have not turned down a Government job offer. People who can retire under section 8414(c) cannot use this rule. Annuity payments stop if the person is later appointed to a Government job, if they refuse a job offer under subsection (b), or as stated in section 8455(a). Any person applying for or getting this annuity must be considered by an agency for any vacant job in the person’s commuting area before the agency fills it, if the person is qualified, the job is the same grade as their old job, and the Office’s rules are followed.
