It is illegal for a representative payee — a person who gets benefit payments for someone else — to steal or use any of those payments for anything other than helping the person they are supposed to help. If the Office finds a representative payee did that, the Office must quickly take away their certification and start payments to another payee or to the individual if that is better. A person who breaks this rule can be fined under Title 18, jailed for up to 5 years, or both.
