Creates a Federal Retirement Thrift Investment Board in the Executive branch. The Board has five members. The President appoints three members and picks one of them to be Chairman. The President also appoints two members after considering recommendations: one after the Speaker of the House consults the House minority leader, and one after the Senate majority leader consults the Senate minority leader. Unless section 311 of the Federal Employees’ Retirement System Act of 1986 says otherwise, the Senate must confirm appointments. Members must have strong experience with investments and pension plans. Terms are four years, but the first members are staggered so the Chairman serves four years, the two recommended members serve three years, and the others serve two years. Vacancies are filled the same way and appointees finish the old term. A member stays in place until a successor takes office. The Board sets policies for investing and managing the Thrift Savings Fund and for running related retirement programs. It reviews investment performance and approves the Board’s budget. The Board can adopt a seal, direct the Executive Director to carry out its policies, remove the Executive Director for good cause if four members agree, and take other needed actions. The Board cannot tell the Executive Director to buy or sell a specific asset, except for investments under section 8438(c)(2)(B). Members must act only in the interest of plan participants and beneficiaries. The Board must send an annual budget to the President and the proper Congressional committees as a separate item in the budget under section 1105 of title 31. The Board may also send legislative recommendations to the President and to each House of Congress.
