The Office of Personnel Management can make rules needed to run this part of the law. The rules can say when and under what conditions an employee gets coverage. After talking with agency heads, OPM can exclude workers because of the kind of job or conditions, like short‑term, seasonal, or intermittent work. OPM cannot exclude someone only because the job is hazardous; cannot exclude a District of Columbia Board of Education teacher paid under section 1501 of title 31 who has worked under temporary appointments for periods totaling not less than two school years; and cannot exclude an employee in a part‑time career employment basis (see section 3401(2)). The Secretary of Agriculture must make rules for the person named in section 8701(a)(8).
