Defines key words used later in this subchapter so people know what they mean. "Assistance" means giving or letting someone access information (like message content or records), facilities, or other help. "Civil action" includes a "covered civil action." "Congressional intelligence committees" means the Senate Select Committee on Intelligence and the House Permanent Select Committee on Intelligence. "Contents" has the meaning in section 1801(n). A "covered civil action" is a lawsuit in Federal or State court that says an electronic communication service provider helped an element of the intelligence community and asks for money or other relief because of that help. An "electronic communication service provider" covers many communication companies: telecom carriers (see section 153 of title 47), providers defined in section 2510 of title 18, remote computing services (section 2711 of title 18), other providers with access to communications or the equipment that transmits or stores them, their parent/subsidiary/affiliate/successor/assignee companies, and their officers, employees, custodians, or agents. It does not include entities that primarily serve as a public accommodation facility (section 1861(4)), a dwelling (section 3602 of title 42), a community facility (section 1592n of title 42), or a food service establishment (section 1638 of title 7). "Intelligence community" has the meaning in section 3003(4). "Person" means either an electronic communication service provider or a landlord, custodian, or other person who may be ordered or directed to provide assistance under section 1803(a), a written certification under section 2511(2)(a)(ii)(B) or 2709(b) of title 18, or a directive under section 1802(a)(4), 1805b(e) (as added by section 2 of the Protect America Act of 2007 (Public Law 110–55)), or 1881a(i). "State" means any State, political subdivision, the Commonwealth of Puerto Rico, the District of Columbia, any U.S. territory or possession, and includes any officer, public utility commission, or other body that can regulate an electronic communication service provider.
