Title 50 › Chapter 47— NATIONAL SECURITY AGENCY › § 3610
The Secretary of Defense can set up a special personnel system at the National Security Agency called the Senior Cryptologic Executive Service for senior civilian cryptologic staff. The rules must follow Senior Executive Service standards in 5 U.S.C. 3131 and make positions fit 5 U.S.C. 3132(a)(2). The system must set pay inside the SES pay range in 5 U.S.C. 5382 and change pay at the same times and by the same amounts as the SES. It must include a performance review system like subchapter II of chapter 43, removal rules like 5 U.S.C. 3592 and 7543 (with hearings done under Department of Defense rules), and allow performance awards, sabbaticals, and recertification as described in the listed Title 5 provisions. The Secretary may also apply other Title 5 SES rules to these employees and may hire or move people into these jobs without using competitive-service rules. The President may give ranks under 5 U.S.C. 4507. The NSA Director can assign members to work outside the NSA without them losing their SES status. The Secretary may create a merit pay system for NSA staff consistent with 5 U.S.C. 5401(a). A member’s total pay in any fiscal year cannot be more than the annual rate for Executive Schedule Level I in effect at the end of that year.
