An Indian tribe can take over all or part of the job of a State Historic Preservation Officer for tribal land under sections 302302 and 302303, as those duties may be changed for tribal programs by rules from the Secretary. To do this, five things must happen: the tribe’s chief governing authority must ask for it; the tribe must name a tribal preservation official to run the program (by appointment or tribal law); that official must give the Secretary a plan explaining how the duties will be carried out; the Secretary must consult with the tribe, the State Historic Preservation Officer, the Council (if the tribe seeks review authority under section 306108), and any other affected tribes and determine the plan works, shows what duties remain with the Secretary and State officer, and allows the State officer to act for non-tribal or non-trust properties if the owner asks; and finally the Secretary must approve the plan.
