Title 6 › CHAPTER 1 — HOMELAND SECURITY ORGANIZATION › SUBCHAPTER IV — BORDER, MARITIME, AND TRANSPORTATION SECURITY › Part E — Citizenship and Immigration Services › § 279
Gives the Director of the Office of Refugee Resettlement (ORR) the job of caring for unaccompanied alien children who are in Federal custody because of their immigration status. The Director must coordinate and carry out their care and placements, make and put into effect placement decisions, find and oversee facilities and staff, try to reunite children with a parent abroad when appropriate, keep and publish an annual list of guardians and lawyers, and inspect and follow up on places where children live. The Director must make a plan for Congress to ensure qualified, independent lawyers are appointed in a timely way consistent with the law in effect on November 25, 2002. The Director must consult juvenile justice experts and immigration and border officials when placing children to help ensure they appear at hearings, are protected from smugglers or traffickers, and are not placed where they would be a danger to themselves or others. The Director may not release such children on their own recognizance, but a bond is not required if a child is released to a qualified sponsor. The Director must collect and keep statistics and case data, including biographical details (name, gender, date of birth, country of birth, and country of habitual residence), the date the child entered custody, each placement or release and reasons for any detention or release, and the outcome of the child’s cases. The Director should consider using the refugee children foster care system (section 412(d) of the Immigration and Nationality Act, 8 U.S.C. 1522(d)). The change takes effect when the transfer under section 251 becomes effective. Any law or document that used to refer to the old agency head or agency will now be read as referring to the ORR Director or the ORR. Department of Justice staff, records, assets, and related funds used for these functions will move to the ORR; any unspent money must still be used for its original purpose. The official who gets these duties can use any legal authorities that were available for the job before the transfer. Definitions used: placement — putting a child in either a detention center or an alternative to detention; unaccompanied alien child — a person under 18 with no lawful immigration status who has no parent or legal guardian in the United States or whose parent or guardian in the United States is unavailable to care for them.
